Spur Terms Of Service

These Terms of Service ("Terms") govern your access to and use of Spur, including the Spur mobile application, website, subscriptions, action recommendations, check-ins, progress tools, and AI-assisted features (collectively, the "Service"). The Service is provided by Shotz App LLC, doing business as Spur ("Spur," "we," "us," or "our").
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Spur is a personal action app that helps users choose a direction, set goals, receive practical action recommendations, complete check-ins, and review progress. The Service may use information you provide about your goals, current circumstances, available time and energy, preferences, and prior activity to suggest a next action.
Spur is not a task manager, emergency service, or professional adviser. We may update, modify, suspend, or discontinue some or all of the Service at any time.
2. Not Professional Advice
Spur provides general planning, organization, reflection, and educational support. It does not provide medical, mental health, legal, financial, tax, employment, safety, or other professional advice, diagnosis, treatment, or emergency services.
Recommendations may not be suitable for your circumstances. Use your own judgment, follow applicable laws and safety requirements, and consult a qualified professional before making decisions that could affect your health, finances, legal rights, employment, or safety.
Do not use Spur as a substitute for urgent or emergency help. If you or someone else may be in danger or experiencing an emergency, contact local emergency services or an appropriate crisis resource immediately.
3. Eligibility And Accounts
You must be at least 18 years old and able to enter into a binding agreement to use the Service.
You are responsible for:
- Providing accurate and current account information.
- Keeping your login credentials confidential.
- All activity that occurs under your account.
- Reviewing recommendations and deciding whether they are appropriate and safe for you.
We may suspend, restrict, or terminate your account if we reasonably believe you violated these Terms, created risk for the Service or others, or used the Service unlawfully.
4. Acceptable Use
You agree not to:
- Use the Service for unlawful, harmful, fraudulent, abusive, or unauthorized purposes.
- Attempt to access another user's account or data without authorization.
- Interfere with, disrupt, overload, scrape, or bypass the security or operation of the Service.
- Reverse engineer or misuse the Service except where applicable law expressly permits it.
- Use AI-assisted features to seek or generate illegal, dangerous, self-harm, abusive, or otherwise unsafe instructions.
- Upload, submit, or transmit content that infringes rights or violates applicable law.
- Misrepresent generated suggestions as professional advice from Spur.
5. Your Content And Data
You retain rights in information you submit to Spur, subject to the rights needed for us to operate the Service.
You grant us a limited, non-exclusive, worldwide license to host, store, reproduce, process, transmit, and display your content as necessary to provide, secure, maintain, support, and improve the Service and to comply with law.
You are responsible for the accuracy and legality of information you provide. The Service may rely on your information to generate directions, goals, milestones, recommendations, reminders, progress summaries, and related functionality.
6. Recommendations And User Responsibility
Spur attempts to provide practical actions based on limited information. It cannot know every relevant fact about you or your circumstances. Recommendations may be incomplete, inaccurate, repetitive, unavailable, or unsuitable.
You are solely responsible for evaluating whether to begin, modify, postpone, or decline a recommendation. Stop any action that appears unsafe, unlawful, beyond your abilities, or inappropriate for your situation. Completing, skipping, or changing a suggested action remains your choice.
Spur does not guarantee that using the Service or completing recommendations will achieve any particular personal, professional, educational, health, financial, relationship, or business outcome.
7. AI-Assisted Features
Spur may offer AI-assisted features, including onboarding synthesis or recommendation wording. When you use those features, limited input and context may be processed by a third-party AI provider, including OpenAI, to generate a response, maintain safety controls, and improve reliability.
AI outputs may be incomplete, inaccurate, or unsuitable. You should not rely on them as professional advice or as the sole basis for important decisions.
We may monitor, limit, change, or block AI-assisted features for safety, abuse prevention, operational, or compliance reasons. Where the app offers a non-AI option, availability or wording may differ.
8. Reminders And Notifications
The Service may offer reminders, alerts, or notifications. These may fail, be delayed, or be affected by device settings, operating system behavior, connectivity, permissions, or third-party services.
You remain responsible for your commitments, deadlines, appointments, safety, and personal decisions. Do not rely on Spur as your only reminder for something important or time-sensitive.
9. Subscriptions, Purchases, And Trials
Some features may require a paid subscription.
If you purchase a subscription through the iOS app, billing and payment processing are handled by Apple through the App Store. Purchases are also subject to Apple's terms, policies, and procedures. Apple's standard end-user license agreement is available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
Subscription terms, billing cycles, renewals, cancellations, refunds, trials, and restores may be governed by the applicable app store or payment provider. You can manage Apple subscriptions through your Apple account settings.
Except where required by law or determined by the payment provider, fees are non-refundable. We may change pricing, features, trials, offers, and subscription plans to the extent permitted by law and platform rules.
10. Privacy
Our Privacy Policy explains how we collect, use, share, and protect personal information. By using the Service, you acknowledge that we may process information as described in the Privacy Policy.
11. Third-Party Services
The Service may rely on or interoperate with third-party services, including Apple, RevenueCat, Supabase, OpenAI, and other infrastructure providers.
We do not control and are not responsible for third-party services. Your use of those services may be subject to their own terms and privacy policies.
12. Intellectual Property
The Service, including its software, design, branding, content, action systems, and other materials provided by us, is owned by or licensed to Shotz App LLC and is protected by applicable intellectual property laws.
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. No other rights are granted.
13. Service Availability
We do not guarantee that the Service will be uninterrupted, secure, error-free, or available at all times. To the extent permitted by law, we may change, suspend, or stop any part of the Service without liability.
14. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that recommendations, reminders, sync, AI-generated outputs, subscription status, progress information, or stored data will be accurate, complete, timely, secure, safe, suitable, or error-free.
15. Limitation Of Liability
To the maximum extent permitted by law, Shotz App LLC and its affiliates, officers, employees, contractors, agents, partners, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunities, personal outcomes, or other intangible losses arising out of or related to the Service.
To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Service will not exceed the greater of:
- The amount you paid to us for the Service in the 12 months before the event giving rise to the claim.
- $100 USD.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Shotz App LLC and its affiliates, officers, employees, contractors, agents, partners, and licensors from claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- Your use of the Service.
- Your content or data.
- Your violation of these Terms.
- Your violation of applicable law or the rights of a third party.
17. Termination
You may stop using the Service at any time.
We may suspend or terminate your access if we reasonably believe you violated these Terms, created risk, or used the Service unlawfully.
Termination does not automatically cancel subscriptions managed by Apple or another payment provider. You must manage cancellation through the applicable provider.
18. Governing Law And Venue
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of law principles.
To the extent permitted by law, any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Wisconsin, and you consent to the personal jurisdiction and venue of those courts.
Nothing in these Terms limits non-waivable consumer rights you may have under applicable law.
19. Changes To These Terms
We may update these Terms from time to time. If we make material changes, we may provide notice by updating the date above, posting a notice in the app or on the website, or using another appropriate means.
Your continued use of the Service after updated Terms become effective means you accept the revised Terms.
